16.4 Testimonium—traditional format

The traditional practice (although it is not a legal requirement) is to commence the testimonium with the words

‘AS WITNESS’

in the case of agreements made ‘under hand’, and

‘IN WITNESS’

if the agreement is executed as a deed.
