11.4 Expiry of defined period

In determining the expiry of a period of time, fractions of a day are normally excluded. For example, if a party must give a month’s notice, the period expires at midnight on the last day of the month1. Therefore, ‘where a person under an obligation to do a particular act has to do it on or before a particular date he has the whole of that day to perform it’2.
