1.7.2 Individuals

  1. (a)

        A seal is no longer needed, but the document must be signed and witnessed. There is no longer any requirement for a deed executed by an individual to be sealed. The traditional phrase ‘signed, sealed and delivered’ summarised the former legal requirements for execution of a deed by an individual.

    The deed must be signed either:

    1. (i)

          by the individual in the presence of a witness who attests the signature; or

    2. (ii)

          at the direction of the individual and in his presence by someone else, and in the presence of two witnesses who must
