6 Requirements of the Bills of Sale Act 1878

The following are the principal requirements of the Bills of Sale Act 1878:

  1. 6.1

        Every bill of sale to which the Act applies must set forth the consideration for which the bill was given1. Subject to this, an absolute bill, unlike a security bill, need not be in any particular form.

  2. 6.2

        An absolute bill must be attested by a solicitor of the Senior Courts, and the attestation must state that before the execution of the bill its effect was explained to the grantor by the attesting solicitor2.
