25 Effect of non-compliance with statutory requirements: security bills

25.1 Consideration and form

In the case of security bills, the effect of non-compliance with the provisions of the Bills of Sale Acts varies according to the nature of the default.

If a bill of sale is given in consideration of a sum under £30 or if it is not in accordance with the statutory form it is void1. This means that not only is the bill ineffective to give the grantee rights over the goods comprised in the bill but in addition he is disabled from enforcing the personal covenants for payment
