(b) Procedure on creditor’s petition

99 Where the petition should be presented

The court to which the petition should be presented has been considered above and does not require repetition here1. The petition must contain sufficient information to establish that it is brought in the appropriate court2. It is necessary to make a search in the pending actions register under the Land Charges Act 1972 to establish there is no other pending petition and include a certificate at the end of the petition as to the result of the search3.
