88.1 Centre of main interests

The conditions founding jurisdiction for a creditor’s petition and for a bankruptcy application are the same (though in different Sections1) and no separate discussion is required.

  1. A bankruptcy petition may only be presented (or bankruptcy application made) if:

  2. 88.1.1

        the centre of the debtor's main interests is in England and Wales, or

  3. 88.1.2

        the centre of the debtor's main interests is not in a member state of the European Union which has adopted the EU Regulation, but

    1. (a)

          the debtor is domiciled in England and Wales, or

    2. (b)

          at any time in the period
