81 Service of the statutory demand

The Insolvency (England and Wales) Rules 2016 are differently arranged from their predecessors but, it is thought, are to the same practical effect. Rule 10.2 now simply says that, as before, the creditor is under an obligation to do all that is reasonable for the purpose of bringing the statutory demand to the debtor’s attention1. Previously, the rules went on to say that, if it were practicable, the demand should be served personally and, although this is not now stated, it remains the usual mode of service1.
