57.3 Ground (b)

Ground (b) covers any material irregularity at, or in relation to, the creditors’ decision procedure, including irregularities involving voting in respect of which there may also be an appeal under the 2016 Rules1. Appeals may, therefore, be brought together against the convener’s decision as to a creditor’s entitlement to vote and against the creditor’s approval of the IVA2. A secret arrangement between the debtor’s friend and two creditors has been held to be a material irregularity for the purpose of ground (b)3.
