55 Role of the court

The nominee may convene a creditors’ decision procedure without any order. The decision procedure is conducted in the same way as if by court order and is governed by the same statutory provisions as apply to a meeting summoned pursuant to such an order1. However, there is no court involvement in the process. The court does not consider either the nominee’s report or the chairman’s report unless an application is made in relation to the IVA or proposed IVA under the Insolvency Act 1986 or the Insolvency Rules 19862.
