355 Hearing of the petitions

The court is required to fix the hearing of the petition against the partnership first before the hearing of the petitions against the partners1. Before the commencement of the hearing, the petitioner must hand to the court a notice in the prescribed form2 detailing the partners against whom concurrent petitions have been served3.

On the hearing of the petition against the partnership, the court may make such order as it thinks fit, including directions as to the future conduct of any insolvency proceedings in existence against any insolvent partner, but the court may not refuse to
