334 Appointment of administrator out of court

An administrator will normally be appointed by the members of the partnership under Paragraph 22 of Schedule B1 to the Insolvency Act 19861. The notice of appointment will normally be in Form 1B in Schedule 9 to the Insolvent Partnerships Order 19942. It is a notice to the court and must be filed in accordance with the Rules in order that the administrator is duly appointed. No court order is made: filing the form duly completed makes the appointment.
