326 Voluntary arrangements of members

Where insolvency orders are made against an insolvent partnership and an insolvent member of that partnership in his capacity as such, the relevant individual or corporate member may enter into an IVA or CVA, as appropriate. In that case, all the creditors of the partnership are to be treated as the creditors of the individual or company concerned1.

The provisions of the Insolvent Partnerships Order 1994 do not affect the personal position of any partner. Any individual or corporate member of a partnership may enter into voluntary arrangements irrespective of the state of
