(1) INTRODUCTION TO INSOLVENT PARTNERSHIPS

315 General

The law governing both the insolvency of partnerships as separate entities and individual partners is contained in the Insolvent Partnerships Order 19941. The Insolvency Act 1986 authorises the Lord Chancellor, with the concurrence of the Secretary of State and the Lord Chief Justice, to apply provisions of the Insolvency Act 1986 to insolvent partnerships subject to appropriate modifications2. For the purposes of insolvency, a partnership is treated as an unregistered company, and may be subject to insolvency procedures independently of the individual or corporate partners who are its members.
