310 Effect of a debt relief order

The immediate effect of a debt relief order is the imposition of a moratorium in relation to the qualifying debts specified in the order commencing on the effective date1 and continuing for a period of one year2. During that period, any creditor to whom a specified qualifying debt is owed3:

  1. 310.1

        has no remedy4 in respect of the debt; and

  2. 310.2

        may not, except with the permission of the court and on such terms as it may impose, present a creditor’s petition in respect of the debt or otherwise commence any action or
