281 ‘Use it or lose it’

The Enterprise Act 2002, which amended the Insolvency Act 1986, introduced statutory restrictions on the ability of the bankrupt’s trustee to sell the bankrupt’s home with effect from 1 April 20041. Where property comprised in the bankrupt’s estate consists of an interest in a dwelling-house which, at the date of the bankruptcy, was the sole or principal residence of the bankrupt, the bankrupt’s spouse or former spouse (or civil partner or former civil partner), then, at the end of the period of three years2 beginning with the date of the bankruptcy3, that property ceases
