276 General

It is necessary to note the provisions of the Insolvency Act 1986 which relate to this particular asset though the law relating to a trustee establishing his right to the bankrupt's share in a house he jointly owns involve principles of general law. The house which provides the bankrupt and his family with their home is often the principal asset in the estate available for realisation and distribution among the creditors. As selling the house is likely to render not only the bankrupt but also his family homeless, a conflict arises between the creditors
