271 Bankruptcy debts from which bankrupt is not released

271.1 General

‘Bankruptcy debts’ are defined primarily by reference to the time at which they arose1. However, there are certain categories of debt from which the bankrupt is not released on his discharge even though the obligation by reason of which the debt or liability arose occurred before the commencement of the bankruptcy. The principal categories of such debt are2:

  1. 271.1.1

        damages for personal injuries and family liabilities;

  2. 271.1.2

        certain liabilities arising under the criminal law such as fines; and

  3. 271.1.3

        liabilities arising from fraud or
