255 Other postponed debts: commercial venture loans

Where a loan is made to a person engaged or about to engage in any business, on the basis that the lender is to receive either a rate of interest varying with the profits, or a share of the profits arising from carry on the business, the debt represented by that loan is a postponed debt for bankruptcy purposes1.
