198 Trustee in bankruptcy realising mortgaged property

It is convenient to mention here that, subject to agreement otherwise with the mortgagee, there are special rules about remuneration where a trustee realises assets which are subject to a charge (rather than them being realised by a receiver appointed by the mortgagee or the mortgagee himself)1. These are scale costs (the scale being set out in Schedule 11 to The Rules2) which may be taken as costs of sale from the mortgaged property.
