162 What property vests in the trustee

In a radical departure from the pre-1986 law, what property vests in the trustee depends on whether or not it falls within the definition in the Insolvency Act 1986 of ‘bankrupt’s estate’ as follows1:

  1. 162.1

        all property belonging to or vested in the bankrupt at the commencement of the bankruptcy2; and

  2. 162.2

        any property which is or is treated as being comprised in the estate by virtue of the provisions of the Act which relate to the insolvency of individuals.
