157 Annulment order

The form of the annulment order is set out in the Rules1. In what is a significant change of practice, the order must now dismiss the petition as well as setting aside the order, in all cases2. Previously, it was thought that in some cases where the order to set aside was made under ground (a)3, the convenient course was to set aside the order but re-list the petition4.

Provision will also have to be made for costs. In a late annulment these are likely to be significant and may be contentious. They are:
