15 Bankrupt's estate to vest in official receiver on the making of bankruptcy order

15.1 Position pre-6 April 2017

Under the 1986 legislation, the bankrupt's estate remained vested in him after the bankruptcy order was made, until the appointment of a trustee in bankruptcy, whereupon it vested automatically in the trustee under the Insolvency Act 1986 Section 306. There was always a gap between these two events; during which period the official receiver was appointed receiver and manager of the bankrupt's estate under the Insolvency Act 1986 Section 287, and a period elapsed in which he made inquiries into the bankrupt's
