146 Creditors’ committee

The bankrupt’s creditors may, provided the trustee is not the Official Receiver, establish a committee (‘the creditors’ committee’) to exercise the functions conferred on it by the Insolvency Act 19861. In addition to any functions conferred by any provision of the Act, its functions are to:

  1. 146.1

        assist the office holder in discharging his functions; and

  2. 146.2

        act in relation to the office holder in such manner as may from time to time be agreed2.

Under the Insolvency Act 1986 it has no power to give binding directions to the trustee, significantly altering the previous law. Until recently
