140 Appointment by the Secretary of State

If the Official Receiver decides on a rota appointment (and this is not challenged) he makes an application to the Secretary of State who either makes an appointment or declines to make one1. The Secretary of State issues a certificate of appointment which states the date on which the appointment has effect2.

The appointee must give notice to the bankrupt's creditors of his appointment or, if the court so allows, shall advertise his appointment in accordance with the court's directions, and in that notice must explain the procedure for
