139 Appointment by meeting/decision procedure: the first meeting of creditors

139.1 Before 6 April 2017

Under the old Rules, in particular Rule 6.80, if the Official Receiver called a meeting to decide on the appointment of a trustee (generally referred to as the first meeting of creditors) the agenda would have been as follows1:

  1. 139.1.1

        resolution to appoint an insolvency practitioner as trustee;

  2. 139.1.2

        resolution to establish creditors' committee;

  3. 139.1.3

        where no resolution to establish creditors' committee a resolution fixing the trustee's remuneration (or deferring it to later consideration);

  4. 139.1.4

        where there was a proposed joint appointment
