7 Court procedure in Insolvency

Court procedure in insolvency is governed not only by the Insolvency (England and Wales) Rules 20161 but also by the Insolvency Practice Direction2, and together these are, effectively, a complete code. They provide that the Civil Procedure Rules (‘CPR’) (including any related practice direction) apply generally to insolvency proceedings, with any necessary modifications, except so far as dis-applied by or inconsistent with the Insolvency (England and Wales) Rules 2016 and thus apply to fill any gaps3.
