45 Adjournments

The Insolvency (England and Wales) Rules 2016 provide that the creditors’ decision shall precede the company meeting1.

Under the former procedure where both decisions were taken at meetings, there were rules about adjournments and modified proposals including a provision that if the chairman thought fit for the purpose of obtaining the simultaneous agreement of the meetings to the proposal, the meetings might be held together2. This has not been repeated.
