187 Confirmation by the court—EU Regulation cases

Where the EU Regulation1 on insolvency proceedings has been relied upon to pass a resolution for voluntary winding up2 and it is not intended to swear a statutory declaration of solvency under the Insolvency Act 1986 Section 89, the liquidator should apply to the court in under Rule 21.43 of the Insolvency (England and Wales) Rules 2016 for confirmation by the court.
