165 Creditors' committee

Where an administrative receiver has sent or published a report under the Insolvency Act 1986 Section 48(2), the unsecured creditors may in accordance with the Insolvency (England and Wales) Rules 20161 (the ‘2016 Rules’) establish a committee (‘the creditors’ committee’) of three to five creditors which has power on seven days’ notice to require the administrative receiver to attend before it and supply reasonable information about what he is doing2. Administrative receivers are answerable to creditors and may have to seek the court’s directions (under Section 35 of the Act), about their rights.
