102 Notice of appointment where there is no qualifying floating charge holder

Where there is no qualifying floating charge holder (which may in practice be the commoner case) the notice of appointment must be headed ‘Notice of Appointment of an administrator by a company (where notice of intention to appoint has not been given)’ or ‘Notice of appointment of an administrator by the directors of a company (where a notice of intention to appoint has not been given)’, as appropriate, and must contain the contents prescribed by rule 3.25(2) of the Insolvency (England and Wales) Rules 2016 (the ‘2016 Rules’)1.
