If a security granted to a bank includes a mortgage of land the title to which is not registered, it may be necessary to apply for registration under the provisions of the Land Charges Act 1972. Thus a legal mortgage or charge not protected by a deposit of documents relating to the legal estate affected should be registered as a puisne mortgage1.
