3: REGISTRATION OF BANK MORTGAGES AND CHARGES

13 Charges registrable under the Companies Act 2006

Charges created by companies registered in the United Kingdom, including charges contained in a series of debentures, are void against a liquidator of the company, an administrator of the company or any creditor of the company unless particulars of the charges are registered with the registrar of companies1. The only exceptions are:

  1. 13.1

        a charge in favour of a landlord on a cash deposit given as a security in connection with the lease of land,

  2. 13.2

        a charge created by a member
