It is the general theme of this work that all foreseeable difficulties should be identified and addressed in advance of the bailment. Generally, and subject to the unfair terms legislation, it is possible for the parties to a museum bailment to anticipate and provide for adverse contingencies. But there exists a particular source of difficulty under certain cross-border bailments of cultural objects, in the shape of the third-party title claim1.
