66.3 Activating repossessory rights in time

The seller must take care to ensure that his right to the repossession of the goods for non-payment of the relevant debt(s) crystallises before the buyer has lawfully conferred title on a third party sub-buyer1. Such lawful conferment may be found to have occurred, even though the buyer is not yet the owner of the goods, on one or both of two grounds: that the sale to the sub-buyer is expressly or impliedly authorised by the original sale, thus attracting the Sale of Goods Act 1979 Section 21(1), or that it
