47 Duty on delivery to third party

Where the involuntary bailee delivers the goods to a third party who lacks the authority of the owner to receive them, and the goods are lost, the involuntary bailee is answerable unless in making the delivery he exercised reasonable care1. The involuntary bailee’s obligation is therefore lighter than ordinary liability in conversion, which is strict2. But if the person who makes over the goods to a third party was not in possession at the time, this relaxation of the normal liability in conversion does not apply3. A
