Where a lending institution provides text about the loaned work this will be protected as a literary work1. The borrowing institution will need a licence from the copyright owner before it can reproduce this text in a catalogue. Where the lending institution is not the copyright owner it should make it clear in the loan agreement that it is not the owner and that it is the responsibility of the borrowing institution to obtain the licence of the copyright owner to reproduced the text2.
