168 Where there are no pre-existing photographs

Where no pre-existing photographs of the work exist, or where the lending institution does not provide such photographs for the use of the borrowing institution the loan agreement may well provide that the borrowing institution is entitled to make such photographs as are necessary for the purposes of publicity, condition reports, couriers etc. Where the lending institution owns the copyright or a publication right in the loaned work it will need to grant a licence to take photographs (other than in respect of the limited number of exceptions)1 of the loaned work and
