167 Existing photographs of the work

The lending institution or a commercial subsidiary may provide photographs or transparencies of work for use by the borrowing institution either free of charge or for a rental charge. Provision may be made for payment in the event that the slides or photographs are lost or damaged by the borrowing institution.

Where the lending institution is the copyright owner of these photographs and wishes to restrict the use of these photographs by the borrowing institution to specified acts, provision should be made accordingly in the loan agreement1. Where a third party owns
