136 Exclusions from the Government Indemnity Scheme

In respect of national and non-national borrowing institutions the Secretary of State does not undertake to indemnify the owner for loss or damage which arises or flows from:

  1. 136.1

        war, hostilities or war-like operations;

  2. 136.2

        the negligence or wrongful act of the owner, his servants or agents;

  3. 136.3

        the condition of the object at the time of its loan to the borrower;

  4. 136.4

        restoration or conservation work undertaken to the object (with the agreement of the owner) by the borrower, his servants or agents; or

  5. 136.5

        a claim by a third party
