103 Other termination for breach

Generally, and in common with the law of contract at large, the termination of a museum contract for breach depends on the character of term broken. Care must therefore be taken in articulating the status and legal effect of terms.

If a term is expressly designated as a condition of the contract1, or if exact fulfilment of the term is characterised as being of the essence of the contract2, the normal conclusion is that any breach entitles the innocent party to terminate the agreement forthwith3 irrespective of the degree of loss or damage suffered by that
