An auctioneer must settle the conditions of sale in accordance with the standard of care and skill to be expected from one who practises as an auctioneer1. If the auctioneer enters into a contract to supply services as an auctioneer to a seller who is a consumer then, in addition to duties at common law, there will be a statutory duty to provide the services with reasonable care and skill2.
