29 Application to the court

If an estate agent fails to comply with the statutory requirements as to information under the Estate Agents Act 19791, he may apply to the court for the enforcement of the contract, or variation of the contract2. The court may only dismiss such an application if it considers it just to do so having regard to the prejudice caused to the client by the agent’s failure to comply with the statutory obligation and the degree of culpability for the failure3.
