25 Prohibition on unfair commercial practices

Property misdescription was an offence under the Property Misdescriptions Act 1991, but this was repealed on 1 October 2013, and the Consumer Protection from Unfair Trading Regulations 2008 now apply. These regulations prohibit traders from engaging in unfair commercial practices in relation to consumers1. Unfair commercial practices include misleading actions, misleading omissions and aggressive practices, as defined in the 2008 Regulations2. They also include practices which contravene the requirements of professional diligence and which materially distort the economic behaviour of the average consumer, or are likely to do so3.
