17 Statutory control of estate agents

The principal statute dealing with estate agents is the Estate Agents Act 1979. Members of the Royal Institution of Chartered Surveyors (RICS)1 and the ‘Propertymark’ scheme2 are also bound by the Real Estate Agency Code, currently contained in the RICS Professional Statement3, which re-states and supplements the statutory obligations. Members of the Property Ombudsman scheme are bound by its Code of Practice for Residential Estate Agents, which was introduced on 1 October 20164.
