16 Auctioning tenanted property

The Housing Act 1996 introduced a new procedure for the sale of qualifying residential investments by public auction in cases where tenants have a right of first refusal under the Landlord and Tenant Act 19871. The Landlord and Tenant Act 1987 Section 5, as substituted, provides that, where the landlord proposes to make a relevant disposal by auction, a notice under Section 5B of the Act2 must be served not less than four and not more than six months before the date of the auction.
