84.2 Confidentiality

As between the parties in dispute and any neutral third party involved, confidentiality provisions will cover all matters disclosed and discussed during the course of the proceedings. In the context of a mediation, the ADR agreement may also provide that matters discussed between one party and the mediator in private sessions are to remain confidential between them and are not to be disclosed to any other party without express consent. Such provisions are aimed at facilitating frank and open discussion between the parties and the mediator which should help progress towards a settlement.
