84.1 Overview of key issues

Although the nature of the ADR process is largely a matter for agreement between the parties, the inclusion of provisions relating to confidentiality, the ‘without prejudice’ nature of the process, authority to settle and the immunity of the ADR professional are generally considered to be of key importance, particularly where mediation is concerned.
