83.1 The Civil Procedure Rules

One of the key reforms introduced following the publication of Lord Justice Jackson’s ‘Review of Civil Litigation Costs’1 was the promotion of ADR as an alternative to litigation. The Civil Procedure Rules (CPR) for the courts of England and Wales were updated to reflect his recommendations, and the overriding objective in CPR Part 1 now states that cases should be dealt with both justly and at proportionate cost2.
