81.5 Control

The parties will generally retain a high degree of control over the ADR process and play a role in the selection of any ADR professional, such as a mediator. This stands in contrast to litigation, where the parties will be required to follow the applicable court procedures and will have no say in the selection of the judge appointed to hear their case.
